Terms of Sale

1. Scope

These Terms of Sale govern the sale of the "Premium" subscription for the OpItem application, published by SAS POKEITEM, SIREN 105 186 597, RCS Toulouse, share capital €1,000, 26A route de Léguevin, 31820 Pibrac, France.

Any subscription order implies full and unreserved acceptance of these Terms of Sale as well as the Terms of Use.

2. Description of the paid Service

The OpItem Premium subscription is a digital service providing access to the advanced features of the OpItem application, including:

• Unlimited card and collection management
• Advanced statistics and value history
• Market analysis and tracking tools
• Export and backup of collection data
• Priority access to new features

The exact set of included features may change over time; the features available at the time of subscription are those shown on the Pricing page.

3. Pricing

Prices are shown in euros, inclusive of all taxes. OpItem reserves the right to change its prices at any time, subject to at least 30 days' prior notice given by email. The applicable price is the one in force at the time of subscription or renewal.

4. Ordering process

Subscribing to Premium is done directly within the OpItem application. The user must:

• Hold an active OpItem account
• Select the Premium plan from their account settings
• Enter their payment details
• Confirm the order

A confirmation email is sent to the address associated with the account within minutes of the subscription.

5. Payment

Payment is made online securely through our payment provider. The accepted payment methods are indicated during the ordering process (Visa or Mastercard bank card, etc.).

OpItem does not store any banking data. Transaction processing is entirely delegated to our PCI-DSS-certified payment provider. In the event of a payment failure, access to the Premium features is suspended until the situation is resolved.

6. Term and renewal

The Premium subscription is taken out for the chosen term (week, month or year) and renews automatically for an identical term, unless the user cancels before the renewal date.

A renewal reminder is sent by email at least 7 days before the subscription's expiry date (for the annual subscription).

7. Right of withdrawal

To exercise this right, send an explicit request to [email protected] stating your account email address and the date of subscription.

Exception: in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for digital content whose performance has begun with the consumer's express prior consent and express waiver of their right of withdrawal. If the user has requested immediate access to the Premium features and expressly consented to this, the right of withdrawal no longer applies.

8. Cancellation

The user may cancel their subscription at any time from their account settings or by contacting [email protected].

Cancellation takes effect at the end of the current subscription period. Access to the Premium features remains active until that date. No pro-rata refund will be made for the remaining period, except under the right of withdrawal (section 7). OpItem reserves the right to terminate a subscription in the event of a breach of the Terms of Use, without refund.

9. Refunds

Apart from the statutory right of withdrawal (14 days), no refund is granted for a subscription period that has already begun.

In the event of prolonged unavailability of the Service attributable to OpItem (more than 72 consecutive hours), proportional compensation may be granted in the form of an extension of the subscription, at OpItem's discretion.

10. Changes to the Service and to pricing

OpItem reserves the right to modify the content of the Premium features or the pricing at any time. In the event of a material change unfavorable to the user, the user will be informed by email with at least 30 days' prior notice and may cancel their subscription free of charge before the date on which the changes take effect.

11. Personal data and billing

The data collected at the time of subscription (email address, payment data via the provider) is used solely for managing the subscription and billing. It is processed in accordance with OpItem's Privacy Policy.

Billing data is retained for the legally required period (10 years for accounting records).

12. Governing law and jurisdiction

These Terms of Sale are governed by French law. Any dispute concerning their interpretation or performance that cannot be resolved amicably falls within the jurisdiction of the courts of Toulouse.
