1. Overview

The website www.opitem.xyz and the OpItem application (hereinafter "the Service") are published by:

SAS POKEITEM operates the Service under the trade name OpItem.

Accessing and using the Service implies full and unreserved acceptance of these Terms of Use. If you do not accept these terms, please do not use the Service.

2. Description of the Service

OpItem is an application that lets users:

• Manage and organize their One Piece Card Game collection
• View price estimates based on market data (Cardmarket)
• Track how the value of their collection changes over time
• Access editorial content (blog) about the One Piece Card Game market
• Enjoy advanced features through the Premium subscription

3. Access to the Service and pricing

Access to the Service is offered at several levels:

Free version: basic features, no subscription required.

OpItem Premium: full access to advanced features (unlimited collection, unlimited scans, advanced statistics, value history chart). Pricing:

• Weekly: €1.99 / week
• Monthly: €3.99 / month
• Annual: €34.99 / year (i.e. €2.92/month)
• Lifetime access: €149.99 (one-time payment, no renewal)

Payment and renewal terms (web): subscriptions purchased through the website are processed by Stripe, a PCI DSS-certified payment provider. Renewal is automatic. Cancellation can be carried out at any time from the user account area, free of charge.

Payment and renewal terms (iOS/Android): subscriptions purchased through the mobile apps are managed by Apple (App Store) or Google (Google Play) via their in-app purchase systems. Renewal and cancellation are handled in the settings of the user's Apple or Google account.

OpItem reserves the right to change its pricing terms at any time, subject to reasonable prior notice of at least 30 days sent by email to active subscribers. The user is responsible for keeping their login credentials confidential.

4. Cancellation of the subscription

The user may cancel their Premium subscription at any time from their account settings. Cancellation takes effect at the end of the current subscription period. No pro-rata refund is granted, except in the cases provided for by the statutory right of withdrawal (see the Terms of Sale).

5. Data and price estimates

The price estimates displayed in the application are derived from market data (in particular Cardmarket) and are provided for informational purposes only. They do not constitute an offer to buy or sell, nor financial or investment advice.

OpItem does not guarantee the accuracy, completeness or real-time updating of this data. The user is solely responsible for any decisions they make on the basis of this information.

Important: OpItem does not provide investment advice. Collection-valuation data must not be used as the sole basis for financial decisions.

6. Third-party data

The One Piece Card Game data used in the application (names, expansions, numbers, images) is partly sourced from open and community sources, in particular the tcgapi.io API. Use of this data is subject to the terms of use of their respective providers.

This data is the property of its respective authors. OpItem claims no ownership rights over third-party One Piece content.

7. Editorial content and artificial intelligence

Some of the articles on the OpItem blog may be written with the assistance of artificial intelligence agents, identified as such. This content is reviewed and approved by the OpItem team before publication. OpItem is committed to transparency about the use of AI in its editorial output.

8. Intellectual property

All elements of the Service (design, code, editorial content, the OpItem logo) are protected by copyright and belong to OpItem or its rightsholders. Any reproduction without authorization is prohibited.

The user undertakes to:

• Use the Service lawfully and in accordance with these Terms of Use
• Not attempt to circumvent the Service's security measures
• Not use the Service for unauthorized commercial purposes
• Not extract, scrape or mass-reproduce the Service's data
• Not impersonate another user or OpItem

11. OpItem's liability

OpItem uses all reasonable means to ensure the availability and reliability of the Service. However, OpItem cannot be held liable for:

• Direct or indirect damages arising from use of the Service
• Buy or sell decisions based on the displayed price data
• Service interruptions due to maintenance operations or events of force majeure
• Content published by third parties or accessible via external links

12. Right of withdrawal

The terms relating to the right of withdrawal, refunds and subscription cancellation procedures are set out in the Terms of Sale, section 7.

For subscriptions purchased through the iOS App Store, refund handling is the exclusive responsibility of Apple and is carried out via reportaproblem.apple.com.

13. Account suspension and termination

OpItem reserves the right to suspend or terminate an account without notice in the event of a breach of these Terms of Use, in particular in cases of fraudulent use, hacking attempts, or use connected with counterfeits.

The user may request deletion of their account at any time by contacting [email protected]. Deletion results in the permanent loss of all data associated with the account.

14. Changes to the Service and to these Terms

OpItem reserves the right to modify these Terms of Use at any time. Changes take effect as soon as they are published on the website. Users will be informed of material changes by email or via an in-app notification. Continued use of the Service constitutes acceptance of the updated Terms of Use.

15. Governing law and jurisdiction

These Terms of Use are governed by French law. Any dispute concerning their interpretation or performance that cannot be resolved amicably falls within the exclusive jurisdiction of the courts of Toulouse.
